Consumers have just days left to claim their share of a $1.075 million payout from a class action lawsuit against Injured Workers Pharmacy following a 2021 data breach.
The pharmacy, which is the largest full-service workers’ compensation pharmacy in the U.S., agreed to the settlement after customer information was compromised during the breach. While the company denies wrongdoing, it has opted to resolve the matter with a settlement offering compensation to those affected.
Anyone who believes they were impacted by the breach must submit their claim to the court by December 9, 2024. Eligible claimants could receive up to $5,000 for unreimbursed economic losses, including costs related to credit monitoring or identity theft. In addition, all affected individuals will receive two years of free credit monitoring.
The breach occurred between January and May 2021, affecting both current and former customers. The exposed personal information includes Social Security numbers, birthdates, and contact details. Though the breach was discovered in May 2021, customers were notified in February 2022.

The settlement also includes a pro rata payment of $50 per claimant, though the exact amount will depend on the number of valid claims. The total payout will be reduced for credit monitoring costs and reimbursed losses. To claim the payment, individuals must submit supporting documentation, such as invoices or tax documents, for any unreimbursed losses they experienced. No paperwork is required for those claiming the pro rata payment or the credit monitoring service.
To file a claim, affected individuals can complete the online form on the settlement website or download the form and mail it to the administrator. A unique settlement claim ID will be needed to submit the form.
The final approval hearing for the settlement is scheduled for January 16, 2025.
Other class action settlements with approaching deadlines include a $1.7 million privacy settlement with a filing deadline of December 12, 2024, and a data breach lawsuit against a furniture company with a claim deadline of December 16, 2024.
