Background of the Lawsuit
The lawsuit alleged that Hot Topic misrepresented discounts on certain items, leading to accusations of misleading advertising. The plaintiffs argued that the company violated laws in California and Oregon by inaccurately representing the true savings available to customers.
While Hot Topic has not admitted any wrongdoing, it has agreed to a $12.5 million settlement to resolve the claims and avoid further legal expenses.
Eligibility Requirements
Affected customers can receive payouts from the settlement fund, but they must meet the following four requirements:
- Purchase Location: They must have purchased at least one item from Hot Topic’s website, not in physical stores.
- Residency: Eligible customers must be residents of either Oregon or California.
- Purchase Timeline:
- California residents: Purchases must have been made between March 15, 2019, and July 29, 2024.
- Oregon residents: Purchases must have been made between August 25, 2022, and July 29, 2024.
Filing a Claim
Customers interested in filing a claim do not need to provide receipts or documentation for proof of purchase, although they can include them if they wish. Claims can be submitted through the settlement website created for this case, where customers will need to enter their Class Member ID.
Notices with the Class Member ID should have already been sent out via mail or email to those who qualify. If anyone has not received this information, they can contact the settlement administrator for assistance.
The deadline to file a claim form is October 27, 2024. It is important to note that the exclusion and objection deadline has already passed on September 27.
Payment Details
Eligible claimants will receive a payment of $10 from the settlement. They can choose to receive their funds through a check, electronic payment, or store credits for use on Hot Topic’s website.
A final hearing for the case is scheduled for November 4, and payments are expected to be distributed soon after.
