Nationwide Waffle Cone Recall: FDA Class II Risk Due to Undeclared Milk

According to Newsweek , Hammond’s Candies has issued a recall of its “Dark Chocolate Filled Mini Waffle Cones” after a consumer experienced an allergic reaction to milk, which was not listed as an ingredient on the product label. The recall was initiated on August 30 by the Colorado-based company after the incident was reported.

The product label for the waffle cones declared allergens such as wheat, soy, and tree nuts (coconut) and noted that the product was “packaged in a facility that processes egg, milk, mustard, peanuts, sesame, soy, sulfites, tree nuts, wheat.” However, testing by Hammond’s Candies revealed more than trace amounts of milk in the products, which should have been declared as an allergen.

The U.S. Food and Drug Administration (FDA) classified the recall as a “Class II” risk level, which refers to a situation where exposure to a violative product could cause temporary or medically reversible health consequences, or where the likelihood of serious adverse health consequences is low.

The affected products were sold in 38 states, including Alabama, Arizona, California, Colorado, Florida, Illinois, New York, Texas, and Washington, D.C. Nearly 30,000 units of the 4oz stand-up resealable pouches, bearing the product code “6 91355 90513 5,” are part of the recall. The recalled items have “use by” dates ranging from October 3, 2024, to March 1, 2025, depending on the lot number.

As of November 1, no further allergic reactions had been reported. Hammond’s Candies is still investigating how milk ended up in the products and is asking consumers who purchased the affected waffles to return them for a refund.

Milk is one of the eight major allergens in the U.S., along with eggs, fish, crustacean shellfish, wheat, soy, peanuts, and tree nuts. Reactions to milk can vary from mild symptoms like itching or digestive issues to severe responses, including anaphylaxis. Anaphylactic reactions require immediate medical attention and the use of an EpiPen or similar medication.

Consumers who have purchased the affected waffles are urged to return them for a refund. Hammond’s Candies has not yet responded to requests for comment.

This recall follows a string of other recent food safety issues, including potential listeria contamination in mushrooms, allergens in salad, and glass in salsa.
